General terms and conditions

Last updated: 25 October 2026

§ 1 Scope

These general terms and conditions (GTC) apply to all contracts between Friedenstor Bestattungen GmbH, Cranachstraße 24, 60596 Frankfurt am Main (hereinafter “the Contractor”), and the client concerning funeral services and related services.

Differing, conflicting or supplementary general terms and conditions of the client do not become part of the contract unless their validity is expressly agreed to in writing.

§ 2 Conclusion of contract

The contract is concluded by the client placing the order in writing or verbally and the Contractor accepting it. Verbal side agreements require written confirmation.

The client warrants that they are entitled to place the funeral order (e.g. as next of kin or as an authorised representative).

§ 3 Scope of services

The Contractor performs the services agreed in the funeral order. The precise scope follows from the individual quotation or the funeral contract. The services may include in particular:

  • Transfer of the deceased
  • Laying out and care of the deceased
  • Organisation and performance of the funeral
  • Procurement of coffin, urn and accessories
  • Coordination of official formalities
  • Funeral service and farewell ceremony
  • Grave care and grave design

Third-party services (e.g. cemetery fees, crematorium fees, church services) are ordered in the name and for the account of the client unless otherwise agreed.

§ 4 Prices and payment terms

The prices agreed in the quotation or funeral contract apply. All prices are in euros and include statutory VAT unless stated otherwise.

Invoices are due for payment in full within 14 days of the invoice date. In the event of late payment, default interest of 5 percentage points above the applicable base rate pursuant to § 247 BGB becomes payable.

Costs for third-party services advanced by the Contractor are due for payment immediately upon presentation of the corresponding receipts.

§ 5 Obligations of the client

The client is obliged to provide all documents required to carry out the funeral (death certificate, the deceased's identity document, etc.) in good time and to supply any information required.

Changes to the order must be notified to the Contractor without delay. Additional costs arising from late or incomplete information are borne by the client.

§ 6 Cancellation and termination

Cancellation of the order must be declared in writing. If the order is cancelled after acceptance, the following cancellation fees may apply:

  • Up to 48 hours before services commence: 25 % of the order value
  • Up to 24 hours before services commence: 50 % of the order value
  • Less than 24 hours before services commence, or after they have commenced: up to 100 % of the order value

Services already rendered and third-party costs already advanced must be paid in full in every case.

§ 7 Liability

The Contractor is liable for damage caused by an intentional or grossly negligent breach of duty. In the case of slight negligence, the Contractor is liable only for the breach of a material contractual obligation (cardinal obligation), and then limited to the damage foreseeable and typical for this type of contract at the time the contract was concluded.

Liability for damage resulting from injury to life, body or health, and liability under the German Product Liability Act, remain unaffected.

§ 8 Data protection

Personal data collected in the course of performing the contract is used exclusively to fulfil the contract and processed in accordance with the applicable data protection laws (GDPR, BDSG). For further information, please see our Privacy policy.

§ 9 Place of jurisdiction and applicable law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

The place of jurisdiction for all disputes arising from or in connection with this contract is Frankfurt am Main, provided the client is a merchant, a legal entity under public law or a special fund under public law.

§ 10 Severability clause

Should individual provisions of these GTC be or become invalid or unenforceable, the validity of the remaining provisions remains unaffected. In place of the invalid provision, a valid provision that comes closest to the economic purpose of the invalid provision shall be deemed agreed.
